لقد تم إختياري لموضوع التحكيم التجاري الدولي والتحكيم الداخلي دراسة مقارنة كونه من المواضيع المهمة في الوقت الحاضر خاصة بعد التحول الذي شهده العراق وإنفتاحه على التجارة الدولية والشركات الإستثمارية الأجنبية سواء في مجال النفط والغاز أو في المجالات الأخرى وإن غالبية الشركات الأجنبية تضمن العقود التي توقعها شرط التحكيم وقيام العراق مؤخراً بالتوقيع على العديد من الإتفاقيات الدولية التي تجيز اللجوء إلى التحكيم في المنازعات الدولية التي تحصل بين الأطراف الموقعة عليها.
وإن العراق بصدد إعداد مشروع لقانون التحكيم التجاري ونظراً لإشتراكي في دورات للتحكيم التجاري الدولي إضافة إلى القصور واللبس الحاصل في التحكيم التجاري الدولي وأنواع التحكيم الأخرى.
فقد وجدت من المناسب أن اختار موضوع التحكيم التجاري الدولي والتحكيم الداخلي دراسة مقارنة في كتابة هذا البحث وقد تناولنا فيه دراسة سريعة للتطور التاريخي للتحكيم في مقدمة البحث ثم التحكيم وأساسه وطبيعته القانونية وأنواعه كما تناولنا إتفاق التحكيم وآثاره وعقد التحكيم والقانون الواجب التطبيق على موضوع النزاع وعلى إتفاق التحكيم وإجراءاته وتدخل القضاء في إجراءات التحكيم والقرار التحكيمي والطعن به وتنفيذه وأخيراً تناولنا موقف المشرع العراقي من التحكيم ثم ختمنا بحثنا هذا بخاتمة تضمنت خلاصة للأفكار والآراء التي وردت فيه مع الإستنتاجات والمقترحات التي وجدناها مناسبة.
