ما زال أهل العلم يذكرون رسالة الإمام مالك بن أنس لليث بن سعد وما جاء في جواب الليث له في مصنفاتهم لما حوتا من الكلام الجامع، والاختصار البارع، فيما تجوز مخالفته وما لا، وما يصح في الأدلة وما لا. ولما كان الإمام مالك إمام المدينة والليث إمام مصر، كان بالإمكان استخلاص ما كان عليه علماء أهل البلدين من هاتين الرسالتين من الأصول المرعية، التي هي مقدمة أدلة الفقه الشرعية، وذروة سنام الأصول الاجتهادية.
وقد نظر مؤلف هذا الكتاب بما سطر وأجمل كل من هذين الأحايين في هاتين الرسالتين فرأى أنه محتاج إلى بسط، ومفتقر إلى تفصيل، سيما وقد وقع الخلاف في بعض المرادات من بعض العبارات، فكان أن شرع في هذا التفصيل، في كتابه هذا، مستهلاً هذا التفصيل بمقدمة تضمنت ترجمة الإمامين مالك والليث.
