اقتضتنى طبيعة الموضوع أن أقوم بالربط بين أجزائه، وعرض المسائل الفقهية عرضاً متناسقاً -لذا حاولت استيعاب المصادر المختلفة التى تيسرت لى- ومحاولة جمع النصوص المتفرقة المتصلة بالموضوع الواحد، والمقارنة -فى بعض الأحوال- بين بعضها والبعض الآخر عند الفقهاء. اشتمل هذا البحث على بابين وخاتمة- شمل الأول منها التعريف بالليث بن سعد، ثم رسالة الليث بن سعد إلى مالك.
والباب الثانى يبحث عن أصول مذهب الليث بن سعد، وجاء ذلك فى عدة فصول:
فالفصل الأول عن: القرآن الكريم.
والثانى: عن السنة النبوية الشريفة.
والثالث: عن الإجماع.
والرابع: عن قول الصحابى.
وتحدث الخامس: عن الإجتهاد بالرأى.
وتناول السادس: الحديث عن القياس.
وتحدث السابع: عن سد الذرائع.
وشمل الثامن: شرع من قبلنا.
والخاتمة: تتضمن تلخيصاً لفقه الليث بن سعد رضى الله عنه.
وبعد -مرة أخرى- فقد كنت أعدت هذه الدراسة لأتقدم بها لمؤتمر أعلام الفكر، ثم حالت دون ذلك حوائل، ولم ينعقد المؤتمر، وكان الخير كل الخير فيما اختاره الله تعالى، فظلت تلك الدراسة بين يدى أقلب فيها وأرتب، وأنقح وأهذب حتى شاء الله تعالى أن تنشر فى هذه الصورة، فعسى أن تسد الفراغ فى هذا المجال وأن تنال القبول عند الباحثين المتخصصين المنصفين، ولا تحرم من ملاحظات ونقد الناقدين المخلصين.
