Book Description
تركز هذه الدراسة على تبيان وضع السلطة التنفيذية الإتحادية وفقاً لدستور جمهورية العراق لسنة 2005، من حيث تكوينها، وإختصاصاتها، ومسؤوليتها.
إذ بتباين الوضع الدستوري لتكوين للسلطة التنفيذية الإتحادية في الدول الفدرالية بحسب طبيعة النظام السياسي، إذ تكون أحادية في النظام الرئاسي وتتمثل في رئاسة الدولة كما في الولايات المتحدة الأمريكية، وتكون ثنائية في النظام البرلماني وتتمثل في رئاسة الدولة والحكومة كما في العراق، وتكون جماعية في النظام المجلسي وتتمثل في مجلس تنفيذي إتحادي كما في سويسرا.
وتختص السلطة التنفيذية الإتحادية بمهام غير تنفيذية وأخرى تنفيذية تتمثل بتنفيذ القوانين الإتحادية في أقاليم جميع الوحدات المكونة لدولة الإتحاد، كما تختص بإصدار القرارات الإتحادية التي تهم الدولة بأسرها، أي تهم المصالح الوطنية، وتكون نافذة في أي مكان في الدولة تعنيه هذه القرارات وفي مواجهة أي من الرعايا.
وبصدد مسؤولية السلطة التنفيذية الإتحادية، نشير إلى أن الأنظمة التي تقوم على ثنائية السلطة التنفيذية تقضي بوجود رئيساً للجمهورية لا يمكن مسائلته أمام البرلمان سياسياً في حين يمكن مسائله جنائياً، ويكون رئيس مجلس الوزراء مع مجموعة الوزراء مسؤولين سياسياً أمام المجلس النيابي الذي يحق له أن يوجه أسئلة وإستجواب وتحقيق إلى السلطة التنفيذية، كما يمكن مسائلتهم جنائياً، فأعضاء السلطة التنفيذية وهم بصدد ممارسة مهامهم التي خولهم إياها الدستور، قد يرتكبون بعض الأخطاء التي تؤدي إلى حدوث الكثير من الأضرار والتي ينجم عنها زعزعة النظام والمساس بحقوق الأفراد، وتطبيقاً لمبدأ التلازم بين السلطة والمسؤولية، فقد أخضع دستور جمهورية العراق لعام 2005 جهازي السلطة التنفيذية للمسؤولية، ونظم أحكامها.
