لقد أصبح التحكيم الآن الوسيلة المثلى التي يتجه إليها الأفرادــ بل والدول ــ لحسم المنازعات التي قد تنشأ بينهم، كما يعتبر التحكيم من أهم المواضيع التي عُنى بها القانون الدولي الخاص، باعتباره طريقاً غير تقليدي لفض المنازعات التجارية، وهو لا يكتفي بفض المنازعات إلى جانب قضاء الدولة، وإنما ينافس قضاء الدولة في حكم المنازعات على المستويين الدولى والداخلي.
ومن المنطلق السابق، فقد تزاحمت الدراسات التي تناولت التحكيم، مبينة ماهيته وأهدافه والرقابة عليه، وغيرها من الموضوعات التي تتعلق به، وهذا يؤكد أهمية التحكيم كوسيلة لفض المنازعات بعد أن اتجه العالم إلى العولمة (Globalization) فلم يعد رأس المال وطنياً إلا بالمكان الذي يوفر له النمو والزيادة، وهو ما يقتضى بطبيعة الحال إيجاد نظام بديل للقضاء يتفادى عيوب النظام القضائي المعتاد (وهي التأخير وطول الإجراءات والتكلفة). ولقد استرعى انتباهي أنه على الرغم من زخم الأبحاث والدراسات التي تناولت التحكيم إلا أنها لم تتناول موضوعاً في غاية الأهمية ألا وهو موضوع دور المحكم في الإثبات، وهو موضوع يدخل تحت نطاق الإثبات بصفة عامة أمام التحكيم.
ومن المنطلق السابق أيضاً فقد اتجهت في كتابي هذا نحو بيان مجال سلطة المحكم في الإثبات أمام هيئات التحكيم؛ وذلك من خلال عرض مقارن للنصوص القانونية الوطنية والدولية ولوائح مراكز وهيئات ومؤسسات وغرف ومحاكم التحكيم الدولية وأحكام التحكيم المحلية والدولية، ومزجها بالآراء الفقهية التي قيلت في هذا الصدد.
