يعد موضوع "حماية المستهلك" -فى ذاته- موضوعا حديثا نسبيا وترجع حداثة العهد به إلى أن هذه الحماية لم يكن يختص بها تشريع أو قانون بعينه, بل كانت ومازالت تكلفها تشريعات متنوعة ومتفرقة تنتمى إلى فروع القانون المختلفة التى تختلف فى طبيعتها وموضوعها والمقاصد التى تسعى إلى تحقيقها- ولعل فى هذه ما يفسر استجماع النصوص والقوانين الخاصة بحماية المستهلك لتنظم فى اطار موضوع واحد يسهل تناوله- ومع ذلك فقد رئى مؤخرا ضرورة تناول هذه الحماية فى ذاتها من زاوية الفروع المختلفة للقانون بتنسيق بيها والنظر فى مدى كفايتها, وتدعيمها إذا ما كشف البحث عن قصورها.
والواقع تعد الحماية الجنائى للمستهلك من أهم جوانب الحماية التى يكلفها المشرع لجمهور المستهلكين, فهى الحماية التى يركز المشرع اليها حين يقدر عدم كفاية أو قصور الحماية المقررة فى فروع القانون الأخرى, أو حين يرمي إلى حماية سياسية اقتصادية يتبعها من أجل صالح هذا الجمهور, فحماية المستهلك فيما مضى كانت تجد مجالها فى دائرة القانون الخاص, وبصفة خاصة فى القانون المدني إلى تبين عدم كفاية هذه الحماية وضرورة تدعيمها بحماية جنائية.
وقد قمنا بتقسيم دراستنا لحماية المستهلك إلى ثلاثة فصول على النحو التالي: الفصل الأول: تجريم خداع المستهلك, الفصل الثاني: تجريم استغلال المستهلك, الفصل الثالث: الحماية الإجرائية للمستهلك.
