يكمن الهدف الرئيسي لهذه الرسالة: في وضع تصور واضح ومفهوم لقضية الصراع بين السلطة والحرية والوقوف على أسبابه الحقيقية، والتعرف على مظاهره، وآثاره على العلاقة بين الفرد والدولة وذلك بالوقوف على حقيقة العلاقة بين السلطة والحرية، والعوامل المؤثرة على هذه العلاقة، وتفسير ظاهرة طغيان السلطة على الحرية. والتعرف على أسبابه من أجل وضع معايير محددة وضوابط واضحة لحدود سلطة الدولة إزاء حرية الفرد، وإيجاد الضمانات الفعالة الكافلة للحرية ضد طغيان واستبداد السلطة وتغولها على حقوق الأفراد.
أما بالنسبة للمنهج فقد إعتمد الباحث على عدة مناهج في الدراسة يتمثل في المنهج التاريخي والمنهج الوصفي المقارن. ويجدر بالباحث أن يشير إلى أن البحث لم يعتمد على المنهج القانوني فقط، وإنما كانت دراسة الصراع بين السلطة والحرية دراسة مزدوجة في آن واحد بين الإتجاه القانوني من جهة والإتجاه السياسي من جهة أخرى.
وتحقيقاً للأهداف التي سبق ذكرها رأيت تقسيم الدراسة إلى بابين رئيسيين، عرضت في الباب الأول: للعلاقة بين السلطة والحرية. وفي الباب الثاني للصراع بين السلطة والحرية وأثره على العلاقة بينهما.
