إن مبدا الأصل في المتهم البراءة هو الذي يحدد نطاق حقوق المتهم ويكفل ضمان حريته الشخصية والذي يضمن تطبيق هذا المبدأ هوا لقضاء فرقابةالقضاء تعد ضمانة اكيدة لهذا المبدأ وحماية فعالة لحرية الفرد بصفة عامة وبالنسبة للشرعية الاجرائسية ومدى احترامها فانها تعتبر مجرد حلقة من حلقات الشرعية الجنائية التى يخضع لها القانونالجنائي فهذا القانون يتتبع بالخطى الواقعة الاجرامية منذ تجريمها والعقوبة عليها الى ملاحقة المتهم بالاجراءات اللازمة لتقدير مدى سلطة الدولة في معاقبة مرتكبها حتى تنفيذ العقوبة المحكوم بها عليه. وفي كافة المراحل يضع القانون الجنائي النصوص التى تمس حرية الإنسان سواء عن طريق التجريم والعقاب او عن طريق الاجراءات التى تباشر ضده ومن هذا الاطار يظهر دور القانون في تحقيق الشرعية الجزائية من خلال التطبيق الفعال لقانون العقوبات وضمان الحريةالفردية للمتهم من خطر الاجراءات التى تهدد هذه الحرية. وتعتبر كفالة حق الدفاع وسيلة لتميكن المتهم من درء الاتهام على نفسه فان ذلك لا يمكن تحقيقه الا في ظل محكامة عادلة ومن خلال مجموعة من الاجراءات لذا قيل بان حق الدفاع هو حق المتهم في محاطمة عادلة مؤسسة على اجراءات مشروعة وتبدو اهمية حق الدفاع في انه ستأسس على فكر التوزان بين السلطة الممثلة للدولة في الاتهام وبين المتهم وانطلاقا من هذا حرصت الاعلانات والمواثيق والدساتير والقوانين المنظمة لإجراءات التقاضي على تقرير حق التقاضي وكفالته.
