سنحاول من خلال هذه الدراسة إزالة هذا الشك وجلاء ذلك الغموض الذي يحيط بالنظام القانوني للمرور البريء للسفن الحربية الأجنبية في البحر الإقليمي للدولة الساحلية، وذلك من خلال البحث عن المضمون الموضوعي لهذا النظام، ولا سيما الجوانب الحساسة المتعلقة باستخدام القوة، باتفاقية 1982 لقانون البحار، ثم بيان ما إذا كان النظام القانوني الذي يمكن استخلاصه من أحكام هذه الاتفاقية يمكن أن يطبق على الدول غير الأطراف فيها على أساس أنه يعد قانونًا عرفيًا، وأخيرًا البحث عن القواعد القانونية التي يمكن أن تطبق على الدول غير الأطراف في الاتفاقية إذا كان النظام المستخلص من أحكام اتفاقية 1982 لقانون البحار لم يكتسب بعد الطبيعة العرفية.
ولكن حتى نصل إلى هذا الهدف يجب علينا في البداية أن نتناول بالتفصيل مسألة ما إذا كانت السفن الحربية الأجنبية تتمتع أم لا بحق المرور البري في البحر الإقليمي للدولة الساحلية طبقًا لاتفاقية 1982 لقانون البحار، وما إذا كانت القاعدة التي يتم التوصل إليها طبقًا لأحكام هذه الاتفاقية في هذا الشأن تكتسب طبيعة عرفية أم لا.
كذلك يجب علينا بعد ذلك أن نوضح مضمون القواعد التي تنطوي عليها اتفاقية 1982 لقانون البحار بشأن الإجراءات أو التدابير الخاصة بنطاق استخدام القوة.
كما سنحاول بيان ما إذا كان يمكن لدولة العلم أن تمارس المرور البريء في البحر الإقليمي للدولة الساحلية بالقوة، أو اتخاذ إجراءات ما لفرض هذا المرور عندما يرفض.
وفي النهاية، يبدو من المهم معرفة كيف يمكن تسوية المنازعات التي تنشأ بشأن المرور البريء للسفن الحربية الأجنبية في البحر الإقليمي للدولة الساحلية، طبقًا للنظام القانوني الخاص بالتسوية السلمية للمنازعات المنصوص عليه في الجزء الخامس عشر من اتفاقية 1982 لقانون البحار.
