إن مسألة النظام القانوني لمرور السفن الحربية الأجنبية في البحر الإقلميي للدولة الساحلية كانت، ولا زالت، واحدة من أكبر المسائل الخلافية والمثيرة للجدل في قانون البحار، فقد كانت هذه المسألة من ضمن المسائل المعقدة والشائكة والصعبة أثناء مفاوضات مؤتمر الأمم المتحدة الثالث لقانون البحار.
فبينما كانت بعض الدول ترى - خلال أعمال هذا المؤتمر - أن السفن الحربية الأجنبية تتمتع، على غرار السفن الأخرى، بحق المرور البرئ في البحر الإقليمي للدولة الساحلية، فإن بعض الآخر كان ينظر إلى هذه السفن على أنها تنطوى على خطورة ذاتية، وأن مجرد وجودها في البحر الإقليمي للدولة الساحلية يحمل تهديداً كبيراً لهذه الأخيرة.
وقد أدى هذا الخلاف، إلى عدم إقرار أية قواعد واضحة خاصة بمسألة المرور البرئ للسفن الحربية الأجنبية في البحر الإقليمي للدولة الساحلية في إتفاقية 1982 لقانون البحار.
وعلى ذلك، تحاول هذه الدراسة إزالة هذا الشك وجلاء ذلك الغموض الذي يحيط بالنظام القانوني للمرور البرئ للسفن الحربية الأجنبية في البحر الإقليمي للدولة الساحلية، وذلك من خلال البحث عن المضمون الموضوعي لهذا النظام، ولا سيما الجوانب الحساسة المتعلقة بإستخدام القوة، بإتفاقية 1982 لقانون البحار، ثم بيان ما إذا كان النظام القانوني الذي يمكن إستخلاصه من أحكام هذه الإتفاقية يمكن أن يطبق على الدول غير الأطراف فيها على أساس أنه يعد قانوناً عرفياً.
وأخيراً البحث عن القواعد القانونية التي يمكن أن تطبق على الدول غير الأطراف في الإتفاقية إذا كان النظام المستخلص من أحكام إتفاقية 1982 لقانون البحار لم يكتسب بعد الطبيعة العرفية.
وعليه، قُسم هذا البحث إلى أربعة فصول، أعقبت بخاتمة، وذلك على النحو التالي: الفصل الأول: "الطبيعة القانونية للمرور البرئ للسفن الحربية الأجنبية في البحر الإقليمي للدولة الساحلية"، الفصل الثاني: "التصرفات غير البريئة للسفن الحربية"، الفصل الثالث: "تدابير الدولة الساحلية لمواجهة المرور غير البرئ للسفن الحربية الأجنبية"، الفصل الرابع: "التسوية السلمية للنزاعات المتعلقة بالمرور البرئ للسفن الحربية الأجنبية في البحر الإقليمي للدولة الساحلية".
