تقتضي هذه الدراسة تبيان الكيان القانوني للجريمة البيئية، بيد أنه يتعين علينا قبل أن نخوض في بيان الكيان القانوني للجريمة البيئية وعناصرها المادية والمعنوية، وموانع المسئولية الجنائية حيالها، أن تنطرق إلى تحديد محل الحماية الجنائية فيما يتعلق بالجريمة البيئية، وما إذا كانت البيئة في حد ذاتها هي مناط الحماية الجنائية من عدمه، وما هو مدلول البيئة وعناصرها، وما هو المقصود بالتلوث البيئي ومصادر هذا التلوث وأضراره على الحياة البشرية وغيرها، ثم نعرض لعناصر الجريمة البيئية، وتحديد المسئول عن الجريمة البيئية، والقواعد الإجرائية اللازمة للكشف عن هذه الجريمة والسلطات التي خول الشارع لمأموري الضبط القضائي لضبط الجرائم ومرتكبيها، والجزاءات التي تتناسب وطبيعة هذه الجريمة، وترتيباً على ذلك فإن هذه الدراسة تتبسط إلى أبواب خمسة: (الباب الأول: محل الحماية الجنائية، الباب الثاني: اركان الجريمة البيئية، الباب الثالث: المسئولية الجنائية، الباب الرابع: الضبط القضائي، الباب الخامس: المعاملة العقابية).
