تهدف هذه الدراسة بيان المشكلات التي تثيرها أحكام المساهمة التبعية في الواقع العملي، وصولاً إلى إيجاد حلول تتفق والمبادئ والأصول القانونية، ومنها تحديد الجريمة التي تقوم عليها المساهمة التبعية، وتقتضي الدراسة أن نبدأها بتحديد نطاق المساهمة التبعية، فنخصص الباب الأول من هذا البحث لعرض الجرائم التي يمكن أن تكون محلاً للمساهمة التبعية، وتنقسم هذه الجرائم إلى نوعين: أولهما جريمة الفاعل الوحيد، والأخرى جريمة الفاعل المتعدد، وتعرض في الفصل الأول من هذا الباب جريمة الفاعل الوحيد، ثم ننتقل إلى دراسة جريمة الفاعل المتعدد، أما الباب الثاني من هذا البحث نعرض فيه أركان المساهمة التبعية في ظل الشرائع المختلفة، ونخصص الفصل الأول من هذا الباب لبحث الجانب المادي للمساهمة التبعية، ونستتبع ذلك بدراسة الجانب المعنوي للمساهمة التبعية، ويقتضي هذا الجانب بيان عناصر القصد الجنائي العام والخاص لدى المساهم التبعي.
