يعد المرفق العام الأساس الذي بني عليه العديد من نظريات القانون الإداري في فرنسا ومصر وفي مقدمتها نظرية العقد الإداري، ويعد المرفق العام سمة من السمات التي تميز العقد الإداري، وعلى ذلك سوف نستعرض تعريف العقد الإداري باعتبار أن تعريف العقد الإداري هو توطئة لأزمة لدراسة عقد منح التزام المرفق العام باعتبار أن الأخير فرع والأول أصل، ويتبعه ذلك إشارة لأقدم صور عقد منح التزام المرفق العام، وهو عقد امتياز المرفق العام، ثم يتبعه إشارة لأحكام عقد B.O.T، وأخيرًا سوف نتناول بالدراسة التحليلية لأحكام عقد الشراكة في مشروعات البنية الأساسية وفق أحكام القانون 67 لسنة 2010 والمقارنة بأحكام قانون المناقصات والمزايدات رقم 89 لسنة 1998 والمدعمة بأحكام القضاء الإداري وإفتاء الجمعية العمومية لقسمي الفتوى والتشريع. ونختم هذه الدراسة ببيان أثار عقود المشاركة من الناحية القانونية والاقتصادية وطرق حل المنازعات الناشئة عنها؛ لذا سيتم تقسيم هذه الدراسة على النحو التالي: [الفصل الأول: تطور صيغ عقد امتياز المرفق العام، الفصل الثاني: خصائص وأحكام عقد المشاركة، الفصل الثالث: الآثار القانونية لعقد المشاركة (الحقوق والالتزامات)، الفصل الرابع: الآثار الاقتصادية لمشاريع المشاركة، الفصل الخامس: القانون الواجب التطبيق على عقود المشاركة وطرق حل المنازعات الناشئة عنها].
