يعترض المجالس الشعبية المحلية في ممارستها لاختصاصها عقبات أهمها ضعف أدوات الرقابة المتاحة، وضآلة الموارد المالية الذاتية، بالإضافة إلى ميوعة العلاقة بينها وبين الأجهزة التنفيذية، وتكمن الصعوبة في هذا الصدد في دقة تحديد زاوية المعالجة، وذلك على اعتبار أن الإدارة المحلية من الموضوعات التي تدور في فلك أكثر من علم إجتماعي، كالسياسة والإدارة والقانون.... ويهمنا أن نحدد من البداية أن زاوية المعالجة ستكون في إطار قانوني أساساً دون إغفال لوجهات نظر علماء السياسة والإدارة، هذا من ناحية. ومن ناحية أخرى، تكمن الصعوبة في وجود خلط حول الطبيعة القانونية للمجالس الشعبية المحلية، وهل هي برلمانات صغيرة أم جزء من السلطة التنفيذية في إطار شعبي، وهو الأمر الذي يترتب على التوفيق في تحديده نتائج هامة، لذا سنعرض لهذه الدراسة في فصلين، يخصص أولهما لعرض الوضع القائم للإختصاص الرقابي للمجالس الشعبية المحلية في ضوء التشريع الحالي وآراء الفقه، وذلك من خلال إبراز نطاق هذا الاختصاص من جانب، وإلقاء الضوء على الآليات أو الأدوات القانونية المتاحة لهذه المجالس لممارسة دورها الرقابي من جانب آخر. وفي الفصل الثاني نحاول أن نخضع هذا الإختصاص لتقييم موضوعي نكشف من خلاله عن مدي نجاح المجالس الشعبية أو المحلية أو عجزها عن ممارسة اختصاصها الرقابي، هذا فضلاً عن تحديد أساليب تفعيل وتطوير هذا الإختصاص. وتأتي هذه الدراسة كمحاولة لتقديم رؤية جادة على طريق إصلاح وتطوير الإدارة المحلية في النظام القانوني المصري.
