وتتجلى دقة الموضوع فيما يتطلبه ضمان وحماية الحقوق والحريات العامة للأفراد من توازن مع متطلبات فرض الظروف الإستثنائية أي التوازن القائم بين القاعدة (الأصل) والإستثناء، وتوازن بين الحق والقيود المفروضة عليه بحكم الضرورة خاصة في ظل الظروف الراهنة التي أصبح الأصل فيها إستثناء والأخير قاعدة، الأمر الذي يتعين معه إبراز الضمانات القانونية لحقوق الأفراد وحرياتهم الأساسية والإنطلاق بها من الواقع النظري إلى التطبيق العملي أي نقلها من حالة السكون إلى حالة الحركة.
