إن غاية ما يبرمه الناس بينهم من معاقدات وشروط إنما هو انتقال الأموال بينهم، ومعلوم أن الإنسان لا يحل ماله إلا عن طيب نفس منه، أما إذا تعدى على مال غيره أو فرط فيه فإنه يؤخذ منه وإن لم يصدر منه الرضا، ويد الإنسان تارة تكون يد أمانة، وتارة أخرى تكون يد ضمان، وهذا الكتاب تحدث فيه مؤلفه عن حقيقة يد الأمانة وحكمها، وعن الأيدي المختلف فيها بين الأمانة والضمان، كما بسط فيه الأدلة الدالة على انتفاء الضمان عن يد الأمانة، ثم ختم ذلك بمفهوم تضمين يد الأمانة بالشرط وحكم ذلك وشروطه وكيفية إعماله.
