هذا الكتاب هو محاولة لبناء نظرية لسلطة الدولة في الفقه الدستوري الإسلامي، وقد استبعد المؤلف منذ البداية نظرية السيادة كما عرفها الفقه الغربي من نطاق النظرية الدستورية، مؤسساً ذلك على أن نظرية السيادة نشأت في أوروبا في بيئة مغايرة تماماً للبيئة الإسلامية، ولتحقيق أغراض لا وجود لها في هذه البيئة، وقدم المؤلف تحليلاً لكل من النظريتين: النظرية الإسلامية في سلطة الدولة ونظرية السيادة، ثم بين المؤلف أن سلطة الدولة تنقسم إلى سلطتين فرعيتين هما سلطة التشريع وسلطة التشريع وسلطة التنفيذ، وحرص على أن يبين أن سلطة الأمة في التشريع قاصرة على ما لا نص فيه، وانها ليست مطلقة بل مقيدة بالنصوص الوحيية من القرآن والسنة، وبالنسبة لنظرية السيادة، فإن اساس سلطة الدولة فيها- كما بين المؤلف- هو أساس خيالي مفترض يقوم على فكرة العقد الإجتماعي الذي لا وجود له في الواقع، وسلطة الدولة من حيث مضمونها سلطة مطلقة بغير قيود، وفي مجال تقدير كل من النظريتين رأى المؤلف أن يتخذ معياراً موضوعياً دقيقاً يقوم على قدرة كل من النظريتين على تقديم أساس قانوني مقبول لسلطة الدولة يبرر خضوع المحكومين لها، وعلى قدرتها على تقييد هذه السلطة وتقديم ضمانات لهذا التقييد.
