كان للمرأة اليهودية دور هام في المجتمع اليهودي حيث أثرت فيه تأثيرا ملموسا في مختلف النواحي الاجتماعية والدينية والسياسية وكانت مكانة المرأة فى العصور القديمة لا تعتمد على حقوق محددة يحددها القانون بل كانت تعتمد على الظروف الاجتماعية والمميزات الشخصية لكل امرأة فلم تكن لجميع النساء نفس الحقوق والمكانة الاجتماعية. وقد استمد العبريون قوانينهم وتقاليدهم من المجتمعات الشرقية القديمة التى سكنوا بجوارهم مثل السومريين والبابليين والآشوريين والكنعانيين والعرب فقد اثرت القوانين السابقة لشريعة موسى تأثيا عظيما على الشريعة اليهودية نظرا لتشابة الظروف الاجتماعية للعبريين وتلك الشعوب كما انهم سكنوا نفس المناطق الجغرافية. وقد حاولت الشريعة اليهودية كما حاولت الشرائع السابقةلها أن ترفع من شأن النساء ومع تطور الأوضاع الاجتماعية والسياسية اكتسبت المرأة أهمية جديدة لذلك ظهرت الحاجة إلى مزيد من الحماية والحقوق اللازمة للمرأة وحاول حكماء التلود ان يسدوا العجز القانوني الذي كانت تعاني منه المرأة فقاموا باستكمال بعض القوانين وشرح البعض الآخر شرحا جديدا يتلائم مع الأوضاع الاجتماعية الجديدة كما ابطلوا استخدام بعض الشرائع التى كانت مفيدة في الأزمنة القديمة وأصبح استخدامها عديم الفائدة في وقتهم آنذاك ثار الخلاف بين الفرق اليهودية بين هؤلاء الذين يقدسون التوراة ويصرون على تطبيق شرائعها وبين علماء التلمود الذين ساهموا على المستوى الثقافي في جعل القانون المبلور والمنجز في الواقع من قبل الحكماء ومن خلال الظروف الاجتماعية والسياسية والثقافية الخاصة بالبيئات التى عاش بينها اليهود. والدراسة التالية سوف تبدأ بتقديم صورة عن المرأة في حضارات الشرق الأدنى القديم حتى يمكن المقارنة بين الأوضاع المختلفة للنساء في تلك المنطقة التى تحولت بها الجماعات العبرية ثم تنتقل إلى تقديم صورة عن المرأة اليهودية من خلال شرائع التوراة والتلمود والقانون اليهودي الحديث.
