تقوم الدراسات المقارنة- بشكل عام- بدور كبير في تفهم نظم المجتمعات على اختلاف ثقافتها ومنطلقها الديني والحضاري. وفي هذا البحث دراسة فقهية وقانونية مقارنة بين الفقه الإسلامي وبين القوانين الوضعية الغربية في فقه الأحوال الشخصية، حاولت من خلاله أن أذكر برقي الفقه الإسلامي وثرائه وعظمته.
ولست ممن يتصور أن كل ما في كتب الفقه الإسلامي هو من وحي السماء، ولا أعتقد أن ما وصل إليه الغرب في تقنيناتهم هو شر كله، فقد أخذنا عنهم وأخذوا عنا في وقفات كثيرة عند محطات الالتقاء الحضاري على مدار تاريخهم.
فعندهم من بضاعتنا....، وقد يعجب القارئ لهذا البحث حين يجد تشابهًا في بعض المسائل بين أحكام القوانين الوضعية الغربية وأحكام الفقه الإسلامي. هذا هو الذي "ينفع الناس فيمكث في الأرض"، وهذا هو مجال الدعوة الحقيقية للإسلام أحكامه. وما هذا البحث إلا محاولة للبيان في هذا الجانب من جوانب التشريع.
وقد اشتمل البحث على فصل تمهيدي عن مفهوم الدراسة المقارنة وأربعة أبواب أخرى وخاتمة. أما الباب الأول فقد جعلته لعقد الزواج: تاريخه ومقاصده، ومقدماته، وأركانه، وآثاره مقارنًا في ذلك كله بين الفقه الإسلامي والقوانين الوضعية الغربية. وأما الباب الثاني فهو عن فرق الزواج: طلاقًا وخلعًا وتفريقًا مع بيان موقف القوانين الغربية من ذلك. وأما الباب الثالث فقد أجملت فيه حقوق الأطفال كما يراها الإسلام، وكما هي في القوانين الغربية. وقد وقفت في الباب الرابع مع المؤتمرات الدولية التي تعقد بمجال الأسرة، والشبهات التي تثار ضد الإسلام. وفي الخاتمة وضعت خلاصة البحث مع الإشارة لأهم نتائجه.
