مسألة مثل مسألة شرعية علي مالها من تعلق بأمور اقتصادية واتجاهات اجتماعية ونظم قانونية، يجب ألا تترك للاجتهاد الفردي بل يلزم لحسمها الاستعانة بمجمع علمي وفقهي علي نحو يتوقي به موان الزلل في الآراء الفردية. لذلك تصدى علماء الشريعة الإسلامية لحكم التأمين في عدة محافل علمية وأمام مجامع شرعية، ولهذا المسألة أهمية ظاهرة في نطاق معظم القوانين المدنية للبلاد الإسلامية، كمصر والكويت، التي لم تحط، في تنظيمها لعقد التأمين، بكل مشاكله، الأمر الذي يدفع القاضي لحسم المنازعات الخاصة به، عند غياب النص التشريعي أو العرف، إلي الاستعانة بالمبادي العامة للشريعة الإسلامية.
وثمة نظام قانوني مقارب للتأمين التجاري يقوم بضمان المخاطر غير التجارية وغير القابلة للتأمين وفقاً للطريق التجارية المعروفة، وهي المخاطر التي تتعرض لها الاستثمارات في الدول المضيفة لها. وفي سبيل تشجيع رؤوس الأمال الخاصة والعامة علي الاستثمار في الدول النامية ابتدعت عدة وسائل قانونية لحماية هذه الاستثمارات من بينها تقديم ضمان المستثمر ضد ما يتعرض له من مخاطر غير تجارية، كالتأميم والحروب، في البلد المضيف للاستثمار. ونظراً للفوائد التي يحققها تدفق رؤوس الأموال للخارج واستثمارها في البلاد الأخري فإن الدول المصدرة لرأس المال وضعت نظماً وطنية لضمان هذه الاستثمارات.
وبناءاً علي ما تقدم جعلنا الباب الأول لبيان الواقع الاقتصادي والقانوني للتأمين وعقود ضمان الاستثمار، لندخل بعد ذلك في صلب البحث الذي وزعت الكتابة فيه بين بابين خصصت أحدهما لبيان موقف الفقه الإسلامي من التأمين بينما كرست الباب الآخر لاستعراض البدائل الشرعية للتأمين التجاري.
