قصدت من نسخ خيوط هذا الكتاب، الذي يعالج القواعد التى خصصها القانون المدني المصري لعقد التأمين ، مواجهة المشاكل التى يثيرها هذا العقد في الحياة العملية ، المر الذي اقتضى التعرض لما استقر عليه العرف التأميني وما يرد من شروط بوثائق التأمين وعلى هذا فإن هذا الكتاب لا يعني بشرح الأحكام النظرية لعقد التأمين فحسب ، بل أنه يهتم أيضا بالمشاكل التى ظهرت في العمل على اثر تغلغل التأمين في نواح متعددة للنشاط الإنساني. من هنا كان اهتمامنا باستقراء أحكام القضاء المصري والفرنسي، بالاضافة إلى ما تيسر الوصول إليه من أحكام القضاء في البلاد التى تدور في فلك أو حظيرة القوانين الرومانوجرمانية ومحاولة المقارنة بين النصوص بغية الوصول إلى تركيب قانوني يحتوي على القواعد الكلية لكافة أنواع التامين ، والذي لا يقف عند حدود ما ورد في القانون المدني من قواعد ومثل هذا المنهج يجعل هذا الكتاب على ما نأمل مرجعا يستفاد منه في البلاد العربية التى اتخذت من القانونين الفرنسي والمصري مصدرا تاريخيا لقوانينها.
