بات من المحقق أن الشريعة الإسلامية ركيزة من ركائز التشريع في دول اتحاد الجمهوريات العربية ومن بينها جمهورية مصر العربية، وأصبحت الدراسات المقارنة بين الشريعة الإسلامية والقانون الوضعي ضرورة ملحة بحكم الدستور وبحكمالأمل الذي نتطلع إليه لكي تصبح هذه الشريعة يوماً ما هي المصدر الوحيد للتشريع لا مصدراً له فقط، وانطلاقاً من هذا المفهوم وسعياً وراء هذا الأمل فقد هداني اللهإلى دراسة عقد الصلح بين الشريعة الإسلامية والقانون المدني- دراسة مقارنة فقهية وقضائية وتشريعية- عسى أن تكون محاولة مفيدة من المحاولات التي تبذل لإحياء تراثنا العظيم من الفقه الإسلامي، وسوف نقسم البحث إلى باب تمهيدي وثلاثة أبواب وخاتمة على النحو التالي: (باب تمهيدي:ويشمل أهمية الصلح واقسامه، الباب الأول: ويشمل تعريف الصلح ومشروعيته وخصائصه، الباب الثاني: ويشمل أركان الصلح واثباته، الباب الثالث: ويشمل أحكام الصلح)، وسوف نتناول ما تقدم في الفقه الإسلامي والفقه الوضعي ثم نسجل نتائج الدراسة المقارنة بين الفقهين في كل باب الأبواب، وفي النهاية نعقبعلى ما تقدم بخاتمة نذكر فيها النتائج التي خلصنا إليها من البحث وما نراه من مقترحات.
