وجدت مسائل الهلاك متفرقة في أبواب الفقه المختلفة فأردت جمعها، حتى يتيسر للباحث الإطلاع عليها، ومعرفة أحكامها، وقد عقدت في هذه الدراسة مقارنة بين الفقه الإسلامي والقانون المدني فيما يتعلق بتلك المسائل، وقد قسمت هذا البحث إلى، باب تمهيدي وأبواب ثلاثة وخاتمة: أولاً: الباب التمهيدي: ونتكلم فيه عن تعريف العقد، ثانياً: الباب الأول: ونتكلم فيه عن معنى الهلاك والفرق بينه وبين التلف ونتناول بيان المعقود عليه من حيث تعريفه وشروطه، ثالثاً: الباب الثاني: ونتكلم فيه عن المبادئ الأساسية التي تحكم هلاك المعقود عليه كنظرية عامة حيث نذكر الأسباب التي تؤدي إلى هلاك المعقود عليه، فقد تكون هي القوة القاهرة أو الحادث الفجائي أو خطأ المدين أو الدائن أو الغير. ثم نتكلم عن الآثار المترتبة على هذا الهلاك، رابعاً: الباب الثالث، ونتكلم فيه عن بعض التطبيقات لقواعد الهلاك في العقود، فنذكر حكم هلاك العين المبيعة والعين المؤجرة، والعين المرهونة، والعين المودعة والعين المعارة، خامساً: الخاتمة: ونبين فيها النتائج والإقتراحات.
