Book Description
أن الأصل في إبرام العقود هو مبدأ سلطان الإرادة، وهذا المبدأ يؤدي بنا إلى القول أن كل الإلتزامات ترجع في مصدرها إلى الإرادة الحرة.
وعليه، فإن الإرادة الحرة هي التي تهيمن على جميع مصادر الإلتزام.
وبناءً على ذلك؛ أن الأصل أنه إذا ما أبرم العقد عندها لا يجوز نقضه أو تعديله إلا بإرادة الطرفين أو للأسباب التي يقررها القانون إستناداً إلى أن العقد شريعة المتعاقدين.
هذا ما جاء النص عليه في القانون المدني المصري (م 147)، والقانون المدني الأردني (م 202/1) والقانون المدني الفرنسي (م 1134/2) إذ أن الإتفاقات المبرمة بشكل قانوني تأخذ قوة القانون بالنسبة لمن أبرموها وأنه لا يمكن العدول عنها إلا برضاء الأطراف المتعاقدة.
إلا أن التطورات التي شهدها العالم في جميع المجالات وخاصة الإقتصادية منها أدت إلى عدة تغيرات، كان من أهمها ظهور عقود الإذعان ومنها عقد التأمين، والتي لا يكون للمؤمن لهم الحق في مناقشة شروطها، والأصل أن تبرم العقود بعد مفاوضات بين الأطراف المتعاقدة في جو من الحرية الكاملة في المناقشة ومعرفة كل طرف لكافة حقوقه وإلتزاماته على قدم المساواة بينهما وفقاً لمبدأ الحرية التعاقدية، وهذه الشروط تعتبر مجحفة بالطرف الآخر الذي لم تتوافر له الحرية في مناقشتها.
