يعتبر عقد التأمين من عقود الإذعان حيث أن التوازن بين مركزي المؤمن والمؤمن له غير متحقق... من هذا المنطلق تعتبر شركات التأمين هي المسيطرة والمتحكمة في سوق التأمين، وهي تفرض شروطًا قاسية تنطوي على قدر كبير من الظلم والتعسف، حيث أن مخالفة أي من هذه الشروط التعسفية يؤدي إلى سقوط حق المؤمن له أو المستفيد قبل المؤمن... ولا يملك المؤمن له أو طالب التأمين مناقشة هذه الشروط التي يضعها المؤمن.
لذلك يجب على المشرع أن يتدخل لحماية حقوق المتعاملين مع شركات التأمين من الظلم والتعسف وذلك بوضع نصوص آمرة للحفاظ على حقوق المؤمن لهم والمستفيدين من التأمين... كما يجب على أي جهة قضائية تنظر منازعة من منازعات التأمين أن تراعي جانب المؤمن له أو المستفيد من التأمين باعتباره طرفًا مذعنًا وتفسر بنود عقد التأمين بما يتفق ومصلحته... ونظرًا لأهمية هذا الموضوع حيث أن معالجته يحقق الفائدة لطرفي عقد التأمين فيحتفظ المؤمن له أو المستفيد بجميع حقوقه الناشئة عن عقد التأمين... كما أن معالجة هذه الشروط التعسفية يحقق الفائدة أيضًا لشركات التأمين حيث يؤدي إلى إنعاش سوق التأمين وزيادة عدد المؤمن لهم في مختلف فروع التأمين وبالتالي تحقق شركات التأمين أرباحًا وفيرة... لذلك خصصنا هذا البحث لتناول بعض هذه الشروط ومعالجتها بطريقة قانونية تحقق مصالح طرفا عقد التأمين... وقد قسمنا هذه الدراسة إلى الفصول الآتية: [الفصل الأول: الالتزام بالإعلان عن زيادة الخطر، الفصل الثاني: الالتزام بالإعلان عن تحقق الخطر، الفصل الثالث: التزام المؤمن له بالتنازل عن إدارة الدعوى "شرط إدارة الدعوى"، الفصل الرابع: الالتزام بعدم الاعتراف بالمسئولية أو التصالح مع المضرور، الفصل الخامس: تنازل المؤمن له عن حقه في الرجوع على الغير المسئول، الفصل السادس: موقف الفقه الإسلامي من الشروط التعسفية].
