يثبت المؤلف في هذا الكتاب، من الناحية الشرعية، أن الدراسة التي أجراها للتأكد من صحة العلاقات والشروط التي تتضمنها عقود التأمين الإسلامية القائمة على مبدأ التعاون والتكافل ، تعكس ضرورة ملحة لإعادة النظر بالكامل في الهيكل الحالي الذي يقوم عليه نظام التأمين الإسلامي. وذلك تمهيداً لبناء نظام جديد يقوم على أساس التبرع المحض، الخالي تماماً من أي نوع من أنواع المعاوضة. فالمشاركون في نظام التأمين الإسلامي الحالي بجميع أنواعة، يلتزمون بدفع مبالغ نقدية، يطلق عليها اسم "تبرعات"، لشركات التأمين الإسلامية لتغطية الأضرار التي قد تصيب بعضاً منهم في المستقبل. وتلتزم الشركة، في مقابل ذلك، بدفع تعويضات نقدية قد تزيد أو تقل عن الأصل المدفوع في حالة تعرض أي منهم لهذه الأضرار. وهذا النوع من التعامل القائم على عقد الهبة المشروط بثواب أو عوض، يؤدي إلى وقوع جميع المشاركين في النظام، بدون استثناء، في الربا والغرر اللذين يحرمهما ديننا الإسلامي الحنيف.
ويبين المؤلف أن الدراسة أثبتت أيضاً أن جميع الأشكال المؤسسية التي تقوم عليها عمليات التأمين الإسلامية الجاري عليها العمل حالياً، كشركة المضاربة، أو صندوق الوقف التبادلي، أو شركة أموال أو شركة تضامن، لا تغير من حقيقة هذا الأمر شيئا، وهو الوقوع في مفسدتي الربا والغرر، لذلك فإن التصور الصحيح الذي يجب أن ينبني عليه نظام التأمين في المجتمع الإسلامي، هو عدم اشتراط أي نوع من أنواع الثواب أو العوض على التبرعات التي يقدمها المشاركون في هذا النظام.
