تعد الجنسية من العوامل المؤثرة في ظهور فرع القانون الدولي الخاص فهي الاداة التي قسمت البشرية بين وحدات سياسية قانونية يصطلح عليها بالدول فأخذت بعدين الاول افقي يتمثل بتوزيع الافراد على دول العالم والثاني رأسي يتمثل بتمييز الوطنيين عن الاجانب داخل الدولة. وتقع الجنسية تحت تأثير جملة قواعد قانونية بعضها من طبيعة عالمية وبعضها الاخرى من طبيعة وطنية فكان على المشرع الوطني في كل دولة ان يراعي ذلك عند وضع أحكام الجنسية وهذا هو سر وجود بعض الاحكام المشتركة للجنسية بين الدول لخضوع المشرع فيها لقواعد عالمية ووجود احكام مختلفة بين الدول وذلك لتأثر المشرع بالخصوصيات الوطنية (الاعتبارات الاجتماعية والاقتصادية والسياسية والثقافية لكل دولة) (القواعد الداخلية) والقواعد الوطنية الداخلية هي العامل الأكثر تأثيراً في حصول ظاهرتي انعدام الجنسية وازدواجها.
ولأجل بيان ما تنطوي عليه الجنسية من مقومات كان لا بد من الوقوف على الاصول التي انحدرت منها الجنسية وقامت عليها ثم بعدها بيان الاسس المعتمدة في بنائها على مستوى الاشخاص الطبيعية والمعنوية وأخيراً تأثيراً اختلاف اسس تعين الجنسية. وذلك من خلال ثلاثة مباحث عرض المؤلف في الاول تأصيل الجنسية وفي الثاني اسس تعين الجنسية وفي الثالث اختلاف اسس تعيين الجنسية.
