من الثابت أن الأفراد تتوزع على شكل وحدات سياسية قانونية يصطلح عليها بالدول، وبأثر تعدد الأخيرة تتعدد الأنظمة القانونية، وإن هذه الأنظمة تتوزع على عوائل قانونية تتمثل بالأنظمة ضمن الإتجاه الإنكلوسكسوني والإتجاه اللاتيني، وهكذا بالنسبة للأنظمة التي تقع ضمن الإتجاه الجرماني والإشتراكي وعلى أثر ذلك تختلف أنظمة كل مجموعة من المجموعات الأخرى، وإذا افترضنا بقاء أفراد كل دولة ضمن محيطها الإقليمي فإن كل دولة ستستأثر بحكم هؤلاء الأفراد عن طريق قوانينها الداخلية دون أن تحتاج إلى قوانين تنظم أوضاع الأجانب.
ولكن هذا الإفتراض لا يستقيم أمام ضرورات الحياة المعاصرة التي تفترضها حركة وإنتقال الأشخاص والأموال عبر الحدود الدولية مما يطرح إختلاف الحالة القانونية بفعل تغير المكان (الموطن) (مركز الأجانب) وظهور علاقات وعقود بأثر ذلك بين أطراف تابعين لدول مختلفة أو لدولة واحدة (الجنسية) حول علاقة موضوعها أموال تقع في دولة أخرى أو بين أطراف تابعين لدولة واحدة تكونت بينها علاقة تعاقدية عن موضوع موجود في نفس الدولة ولكن إبرام العقد تم في الخارج (تنازع القوانين).
إن مثل تلك العلاقات في مختلف الفروض أعلاه لا يمكن أن تعامل بمعاملة العلاقات الوطنية نفسها وهذا يعني لها علاقات غير وطنية يصطلح عليها حديثاً بالعلاقات ذات الأبعاد الدولية الخاصة، فإختلاف المعاملة بين العلاقتين أعلاه يفترض إختلاف القوانين الحاكمة لكل منها، وإختلاف المحاكم التي تنظر في المنازعات الناشئة عنها (تنازع الإختصاص القضائي).
فالعلاقات الوطنية التي تحصل بين الأفراد التابعين لدولة واحدة على موضوع كائن فيها وعن سبب نشأ على أراضيها تخضع بدون خلاف للقانون الوطني لتلك الدولة ولكن العلاقات ذات الأبعاد الدولية المتصلة بعنصر أو أكثر من عناصرها (الأشخاص، الموضوع، السبب) بدولة أو أكثر تخضع لقواعد قانون آخر يصطلح عليه بالقانون الدولي الخاص، وهنا لنا أن نتسال هل أن هذا القانون يحكم فقط العلاقات أعلاه أم أنه يحكم مسائل أخرى؟...
للإجابة عن ذلك استدعى هذا الكتاب البحث في الطبيعة القانونية للقانون الدولي الخاص والمصادر التي يستقي منها أحكامه وهذا يتطلب بدوره البحث أولاً في التعريف به ثم بيان العلاقة بين موضوعاته.
