مما لا شك فيه أن المواطنة بمفهومها السابق تعني أن الجميع - حكاماً ومحكومين - تحت سقف القانون وفي ظل أحكامه، غير أن الشاهد والملموس في دولنا العربيّة - خاصة - أن حكم القانون يأخذ أبعاداً أخرى، تتعلق مرة بإعتبارات دينية (طائفية)؛ ومرة أخرى بإعتبارات لا تمتّ إلى العدالة بصلة، وتكاد تقترب إلى المصالح الضيقة عند تطبيق النصوص على الوقائع.
لذلك نسعى في هذا الكتاب حقوق المواطنة بين ضوابط القانون الداخلي والقانون الدولي العام (دراسة مقارنة بين لبنان والعراق) إلى تأكيد المفهوم الصحيح لحكم القانون (وبالتالي لدولة القانون)، وذلك وفقاً لضوابط مهمة في هذا المجال؛ إن على مستوى الصياغة أو التفسير أو التطبيق القضائي - في القانون الداخلي - وهذه الضوابط تبقى محكومة بالقانون الأساسي (الدستور)، الذي يتربع على رأس القواعد القانونية في كل النظم السياسية والديمقراطية.
