يحتل الإرهاب حيزاً كبيراً من إهتمام فقهاء القانون الدولي والقانون الجنائي، إذ عمت الجريمة الإرهابية بأخطارها وأضرارها العالم بأسره، فلم يعد للإرهابين عقيدة، أو دين، ولا جنسية، أو موطن، ولا فكر سياسي أو ثقافة معينة، وتخلى منفذوها عن الفكر الإرهابي التقليدي، القائم على أساس إغتيال بعض الشخصيات المهمة لإرهاب الملايين ممن يشاهدونها أو يسمعون بها في وسائل الإعلام، ليعتنقو فكراً إرهابياً جديداً قائماً على أساس إرتكاب المجازر البشرية الوحشية، وإيقاع أكبر عدد ممكن من الضحايا، وتخريب وتدمير الممتلكات العامة والخاصة، وإحداث أكبر الخسائر جسامة فيها.
فالإرهاب عمل يولد الرعب والفزع ويؤدي إلى ترويع الإنسان، ولكل عمل إنساني عمدي دوافع (بواعث) تدفع الإنسان إلى إرتكاب الجريمة، والأصل أن القانون العقابي لا يعتد بالباعث إلا في حالات معينة مثل الجريمة الإرهابية والجريمة السياسية، حيث أن القانون لا يدخل في خصوصيات الإنسان والنية لا يطلع عليها إلا الله تعالى، ولكن الإستثناء وإهتمام المشرع بالباعث في حالات خاصة، جعل معظم القوانين الجنائية تشير إليه، فمن خلاله يمكن أن نميز بين الجريمة الإرهابية والجريمة السياسية.
