لا يخفى علي أحد أهمية عقد البيع، حيث يعتبر أكثر العقود المدنية انتشاراً وشيوعاً في حياتنا اليومية، فلا يكاد يمر يوم دون أن يبرم الشخص عدداً من عقود البيع، منها ما هو جليل الشأن، ومنها ما هو نسبي الأهمية، للتصرف فيما زاد عن حاجته من سلع ومنتجات، وللتزود بما يحتاجه منها.
وازدادت هذه الأهمية في الآونة الأخيرة، لما طرأ علي مجالي الإنتاج والتوزيع من تقدم كبير، زاد معه كم المنتجات المعروضة للبيع بشكل كبير، وتطورت معه أساليب التوزيع بصورة مذهلة، ليس علي المستوي المحلي فقط، بل وعلي المستوي الدولي أيضاً، وساعد علي ذلك سهولة المواصلات، وسرعة الانتقال والاتصال، بين مختلف الدول.
فمع بزوغ فجر كل يوم جديد يشهد العالم ميلاد العديد من المنتجات الصناعية مختلفة الأنواع، والأشكال، والأحجام، متعددة الفوائد، والاستخدامات، من سلع استهلاكية، وذلك بسبب الطفرة غير المسبوقة التي شهدها القرن العشرين في مجال التقدم العلمي والصناعي.
لهذه الأسباب وغيرها أضحى من الضروري أن يلتزم المنتج، أو البائع بالإفضاء للمشترى بكافة بيانات منتجاته، حتي يتسنى له العلم بها، وتجنب أضرارها التي لم تعد تقتصر علي شخص واحد، بل قد تمتد إلي آلاف بل ملايين الأشخاص علي مستوي العالم، والتي لم تقتصر أيضاً علي كسب فائت أو خسارة لاحقة بل امتدت إلي أضرار بدنية فادحة، وخسارات مالية جسيمة، وهو ما يدل علي الأهمية البالغة للالتزام بالإفضاء ببيانات الشئ المبيع بصفة عامة وبما يكتنفه من مخاطر علي وجه الخصوص.
وأظهر هذا الأمر القصور التشريعي في هذا المجال، حيث لم يتضمن القانون المدني المصري أو الفرنسي نصاً يلقي علي عاتق المنتج أو البائع بعبء هذا الالتزام بالرغم من شدة أهميته.
وأصبحت القواعد القانونية العامة وخاصة المتعلقة بسلامة وصحة الرضاء، قاصرة عن حماية المشترى من مخاطر المنتجات الصناعية، وما ينجم عنها من أضرار.
وإزاء هذا القصور التشريعي، وزيادة ما يتعرض له المستهلكون للمنتجات الصناعية من أضرار، كان لابد أن تكون هناك وقفة لحماية هؤلاء المستهلكين من جشع التجار والصناع من ناحية ولضمان سلامتهم من أضرار هذه المنتجات من ناحية اخرى.
