يدرس هذا الكتاب أنماطاً عدّة من العلاقة التي قامت بين الفقيه (ممثّل الدين) والسلطان (ممثّل السياسة) في تجربتين مديدتين هما من أكثر تجارب التاريخ الإسلامي طولاً ودلالات: تجربة الدولة العثمانية وتجربة الدولة الصفوية-القاجارية في إيران. وتبيّن الدراسة أن تطوّر أشكال التأسيس الوظيفي لهذه العلاقة حصل باتجاهات مختلفة: تجنّب السلطان، أو نصيحة السلطان، أو الالتحاق به، أو الخروج عليه...
لكن وعي حالة الاستبداد السلطاني بفعل المقارنة بين الوضعيات المختلفة في التاريخ العالمي، الاوروبي والإسلامي، في غضون القرن التاسع عشر، أدّت إلى حالة من الوعي الفقهي بأهمية الدساتير والبرلمانات في تقييد السلطان. ومن هنا برز في أوساط الفقهاء من جعل همّه تحويل الدولة السلطانية من حكم فردي قائم على علاقات رعيّة إلى حكم دستوري مقيَّد يقوم على التمثيل والمواطنة.
يحاول هذا الكتاب أن يؤرّخ لأنماط العلاقة بين الفقيه والسلطان.. وصولاً إلى بدايات التأسيس لشرعنة الحكم الدستوري بناءً على اجتهاد بعض الفقهاء الإصلاحيين.
