اقتضت قاعدة قانونية الجرائم والعقوبات حرمان القاضي الجنائي من كل سلطة نحو تجريم أوجه السلوك وتقرير العقوبات المناسبة لها وهكذا غابت كل سلطة تقديرية للقاضي في هذا المجال.
على أن الأمور اتجهت نحو التطور بعد ظهور عديد من المذاهب والمدارس الحديثة التي اتجهت إلى نبذ قاعدة قانونية الجرائم والعقوبات في صورتها التقليدية حيث ظهر الاتجاه نحو تخويل القاضي الجنائي سلطة واسعة في اختيار التدابير الاحترازية المناسبة التي شاركت العقوبات التقليدية في دورها الجزائي.
وإذ ازداد التوسع في السلطة التقديرية للقاضي الجنائي في مجال اختيار العقوبة بين تلك التي يوردها المشرع واختيار القدر المناسب منها بل الأمر بوقف تنفيذها أحيانًا- فقد عزمنا على دراسة هذا الموضوع لتحديد أبعاده وإلقاء الضوء عليه والبحث نحو تجميع شتات أحكامه في محاولة متواضعة نحو إقامة نظرية في شأنه.
وقد رأينا أن نعرض إلى هذا الموضوع من خلال مباحث ثلاثة: الأول نتحدث فيه عن ظهور فكرة السلطة التقديرية للقاضي الجنائي وتميزها عن غيرها من الأفكار، الثاني نبحث من خلاله عن دور القاضي الجنائي في تقدير العقوبة وتخفيضها وتشديدها ووقف تنفيذها، الثالث نعرض فيه الرقابة القضائية على تقدير العقوبة ووقف تنفيذها.
