قوة الحكم الجنائي في إنهاء الدعوى الجنائية ذات جوانب متعددة: فالقاضي الذي أصدر الحكم لا يجوز له أن يعود إلى البحث فبما قضي به، ولو تبين له خطأ قضائه فاستصوب الرجوع عنه، فالدعوى قد خرجت من حوزته واستنفد فيها ولايته فلا سبيل إلى أن ينظر فيها من جديد.
ولقوة الحكم الجنائي في إنهاء الدعوى الجنائية جانب ثان: فأطراف الدعوى لا يجوز لهم إعادة طرحها أمام القضاء الذي أصدر الحكم أو أي قضاء آخر، فإن فعلوا كان الإجراء الذي يتذرعون به إلى ذلك غير مقبول. ويقتصر القضاء الذي تطرح عليه الدعوى ثنائية على القول بعدم قبولها دون بحث في موضوعها. ومن ثم كانت هذه القوة أساساً للدفع بقوة الشيء المحكوم فيه أي الدفع بعدم جواز نظر الدعوى لسبق الفصل فيها، والتمسك بهذا الدفع حق لأطراف الدعوى جميعا، وللمحكمة أن تثيره تلقائيا.
وبذلك يكون الحكم المنهي للدعوى حجة على القاضي الذي أصدره وحجة على القضاء جميعا وحجة على أطراف الدعوى كافة، فهو بذلك ناطق بالكلمة الأخيرة في الدعوى، فلا محل لقول جديد فيها. ومن ثم كانت جوانب القوة اثنين: عدم جواز الرجوع إلى الدعوى وعدم جواز النزاع فيما قرره الحكم.
وتتضمن دراسة قوة الحكم في إنهاء الدعوى الجنائية موضوعين رئيسيين: تحديد الأحكام التي تحوز هذه القوة وبيان الشروط المتطلبة للدفع بها. ولكن دراسة هذين الموضوعين يجب أن يقدم لها بعرض للمبادئ الأساسية التي تحدد هذه القوة، وهذا ما سنجده في هذا الكتاب.
