وقد تقررت صور الجزاءات القانونية التى تقررت لحماية الشرعية والتى استهدفت اجبار سلطات الدولة على حمايتها وضمان عدم الخروج عليها- وكان من أهمها جزاء البطلان ذلك الذى يجرد أى عمل اجرائى من آثاره القانونية- على أن الاسراف فى تطبيق هذا الجزاء الخطير قد يؤدى إلى الفرض الذى تتعارض مع نظم المجتمع لذا كان من الضرورى الحد من هذا الجزاء و مقاومة كل المبالغة فى تطبيقه دراسة عديد من النظم والأفكار الازمة لذلك وكان منها اقرار مبدأ تحول الاجراءات الباطلة إلى أعمال صحيحة. وإذا ظهرت فكرة تحول الأعمال القانونية فى عديد من النظم القانونية فقد حرصت بعض القوانين الاجرائية على الاشارة إليها و أن كانن بعضها قد أغفلتها تماما وكان من هذه النظم والقوانين الأخيرة قانون الاجراءات الجنائية المصرى فقد أغفل تماما الاشارة إلى هذة الفكرة كما وأن الفقه الاجرائى الجنائى فى مصر لم يعبرها اهتمامه ولم يعنى بتنظيمها أو اقامة نظرية عامة بشأنها رغم مالها من أهمية فى وضع حد للإشراف فى تطبيق جزاء البطلان.
ازاء ما تقدم رأينا أن نعرض لهذه الفكرة فى محاولة متواضعة نحو ابرازها كنظام قانونى يلعب دوراً هاماً فى مجال تقيم الاجراءات الجنائية و الحد من جزاء البطلان واتجه عزمنا على دراستها وبحتها من خلال مباحث, المبحث الأول: نتكلم فيه عن الشرعية الاجرائية, المبحث الثانى: نعرض فيه للأعمال الاجرائية, المبحث الثالث: نتناول من خلاله الجزاءات المقررة على مخالفة الأعمال الاجرائية للشرعية, المبحث الرابع: نتناول فيه فكرة التحول.
