إذا كان تطور الإنسانية، ينسب إلى أعمال العقل البشري، فإن ذلك مرده، هو البحث عن حقيقة المجهول، وإستجلاء كنهه وفحواه، فالبشرية لم ترقد على حالها الأول، ولم تسبت في بدائياتها الفطرية.
فخلاصة هذا الجهد العقلي، هو البحث عن مزيد من الحقائق وعدم الركون إلى مسلماتها، فما يبذل من جهود ذهنية، بعدم الرفوف عند مرحلة معينة بلغتها الحضارة، هو الأساس الذي قام عليه التطور الراهن في سلم مسيرة الإنسانية.
وإذا كان أهم مبتغى للإنسان في ظل هذه المسيرة، هو الحفاظ على كينونته، بسلامة أمنه، وبكل ما ينطوي عليه هذا الأمن من معان، لا تقتصر على شخصه، بل تتعداه إلى ماله، فإن وقع الجريمة عليه لا يشكل خرقاً لحق خاص يتمتع به فحسب، وإنما هي - أي الجريمة ذات ضرر لا ينحصر فيه، وإنما يتعداه إلى كافة أفراد المجتمع بوجه عام.
ولهذا بات من الضروري، أن تتكفل الدولة وهي تدير القضاء، أن تتولى عن طريقه تشخيص من خرق قواعد نظامها القانوني، ولم يمتثل لإحترام قواعد لإنضباطها، والتي توجب الإنصياع لنصوصها المتوجه إليه ذاتاً، مخاطبة إياه بمغبة خرقها.
ولكن أعمال مغبة هذا الخرق، والمتمثل بالعقاب أصلاً لا يمكن أن يصار إليه، ما لم يتحقق كشف الحقيقة، والحقيقة لا تنتظر من يكشفها كما لا تنكشف عن تلقاء نفسها، بل هي نتيجة بحث جاد وشاق، يستلزم الدقة والإناءة والتفكير الناضج والمتئد والسديد.
من هنا، جاءت الدراسة في هذه الرسالة، لتلقي الضوء على سلطة القاضي الجنائي في تقدير الأدلة وفق منظور قانوني محض، وقضائي عملي، لبناء نظرية متكاملة لهذه السلطة على الصعيدين التشريعي والقضائي، فهي محاولة لإرساء قواعد هذه النظرية، والتي يفتقد إليها العمل القضائي في قطرنا بوجه خاص، كما أنها لم تستقر في الإطار التشريعي بصورة تامة، وسيكون هذا الإرساء على ضوء القضاء العراقي والمقارن وكذلك التشريعات والدراسات المقارنة لإستخلاص الحلول الناجعة لها.
