تبدأ الإجراءات الجنائية بمرحلة التحري والاستدلال واستقصاء الجريمة والكشف عن ملابساتها وملاحقة مرتكبيها وضبطهم ويتولى هذه المهام رجال الضابطة العدلية الذين يستندون في عملهم إلى سلط الدولة في العقاب وملاحقة كل شخص انتهك حرمات النظام الذي اقره المجتمع لأن بروز الجريمة يهدد الناس في أرواحهم وأموالهم وقيمهم ويحرمهم الأمن والاستقرار.
وبعد ذلك تبدأ المرحلة الثانية في الإجراءات، وهي المرحلة التحقيق الابتدائي وهي مرحلة فرض القانون عليها السرية المطلقة وفيها يتم إعداد ملق الدعوى وتجميع الأدلة ويتولى مهمة التحقي قالمدعي العام تحت إشراف النيابة العامة، أما المرحلة الأخيرة من مراحل الإجراءات الجزائية فهي مرحلة التحقيق النهائي التي يتولاه القاضي المختص ويطلق عليها مرحلة المحاكمة، حيث تنتهي هذه المرحلة بصدور حكم قضائي نهائي وبات، ويلي هذه المرحلة القيان بإجراءات تنفيذ العقوبة وتتولى النيابة العامة هذه المهام، وبذلك تنتهي كافة الإجراءات الجزائية.
ولذلك فإن منهاجنا في دراسة قانون أصول المحاكمات الجزائية سيكون على النحو التالي: القسم الأول: دعوى الحق العام ودعوى الحق الشخصي. القسم الثاني: مرحلة التحري والاستدلال. القسم الثالث: التحقيق. القسم الرابع: المحاكمات. القسم الخامس: تنفيذ الأحكام النهائية وسقوط الدعوى والعقوبة.
