لا يخفى أن قانون المرافعات يقوم بدور كبير في تحقيق ضمانات أساسية للخصوم في المحافظة على حقوقهم، واحترامها سواء أكانت من الحقوق المادية أو الأدبية، وعلى وفق ما قدمناه.
ويتجه قول البعض إلى قانون المرافعات هو مجرد قانون إجرائي droit de formalites لا يثير- كما هو الحال بالنسبة للقانون المدني والتجاري- مسائل موضوعية problems de found وإنما على العكس يراه الفقه الحديث، خاصة في ايطاليا وألمانيا علمًا يختلف عن التطبيق العملي la pure pratique، ويثير مسائل موضوعية أساسية، كنظرية الدعوى ونظرية الأحكام والدفوع.
ومن ناحية أخرى، إذا كانت القوانين الخاصة يسودها كقاعدة عامة مبدأ سلطان الإرادة، فإن قانون المرافعات لا يسوده هذا المبدأ كأصل عام، وإنما يخضع لتنظيمات وتوجيهات قانونية مختلفة هي التي تمنحه صفته الإجرائية وهي الصفة الأساسية التي يتميز بها هذا القانون، وعدم احترامها يؤدي إلى ضياع الحقوق الأساسية التي يتميز بها هذا القانون، وعدم احترامها يؤدي إلى ضياع الحقوق الموضوعية، كما هو الحال بالنسبة إلى البطلان والطعن في الأحكام.
وفي هذا الكتاب نتناول نظرية الأحكام في قانون المرافعات من حيث التعريف بها وتحديد أركانها، وتكيفها وتقسيمها وآثارها، وكذلك الأحكام الصادرة قبل الحكم الختامي المنهي للخصومة والأحكام الصادرة بعده، والقواعد العامة في الطعن فيها، والشروط الواجب توافرها في كل من الطاعن والمطعون عليه.
