رغم ما كتب فى نظريه البطلان فى القانون المدنى من ابحات كثيرة فإن نفس الموضوع لم يحظ بعنايه مماثلة فى القانون المرافعات.فقد اقتصر فقهاء المرافعات على معالجة نواح متفرقه منه دون محاولة القيام بدراسة شاملة له ترمى الى وضع نظرية عامة.
ولما كان البطلان تكييفا لعمل قانونى يرتبط بوجود عيب فى العمل فاننا يجب ان نبدأ بحثا بدراسة الاعمال القانونية التى يرد عليها البطلان فى قانون المرافعات فنعرف هذه الأعمال ونبين طبيعتها القانونية .وهذه الدراسة لازمة أيضا لتهدينا إلى المصدر الذى يمكن ان نكمل منه النقص القائم فى التشريع فى موضوع البطلان. إذ تبين لنا ما إذا كانت هذه الاعمال تعتبر تصرفات قانونية تخضع للنظرية العامة لبطلان التصرف القانونى أم أنها أعمال ذات طبيعة خاصة تخضع لنظرية بطلان خاصة بها يجب على الفقيه أمام نقض التشريع أن يستخلصها من القواعد العامة فى قانون المرافعات. وبعد هذه الدراسة ننتقل فى ضوء ما نصل إلية من نتائج إلى بحث أسباب البطلان ثم أحكامه وتكون خطة البحث فى ثلاثة اقسام على النحو التالى القسم الأول فى محل البطلان ,القسم التانى فى أياب البطلان ,القسم الثالثفى أحكام البطلان ونتخذ أساسا لدراستنا قانون المرافعات المصرى مقارنا بالقانونين الفرنسى والايطالى . وقد أخترنا القانون الفرنسى لأنه المصدر التاريخى لغالبية قواعد المرافعات المصرية. ولهذا فان دراسته تساهم فى ايضاح وفهم قواعد القانون المصرى.أما القانون الايطالى فقد اخترناه لأنه يمثل بالنسبة لقانون المرافعات بصفة عامة وبالنسبة لموضوعنا أيضا اقصى ما وصل إليه الفن القانونى.
