يعني قانون المرافعات ببيان الإجراءات والأوضاع التي تلزم مراعاتها عند الالتجاء إلى القضاء، والمواعيد التي يجب أن تحترم عند اتخاذها، ويعني ببيان الجزاء المترتب على مخالفتها وكيفية التمسك بهذا الجزاء. ودراسة نظرية الدفوع تقتصر على بحث الجزاء الذي وضعه المشرع على مخالفة القواعد المنظمة لإجراءات المرافعات وكيفية التمسك بهذا الجزاء.
وإذا كان لا بد من شكلية الإجراءات حتى يطمئن الأشخاص إلى المحافظة على حقوقهم متى اتخذوا الأوضاع التي نص عليها القانون، وحتى يطمئنوا إلى حسن سير القضاء، إذ لا يتصور ترك عليها القانون، أو أمر لمطلق تقدير القضاء، وهم كأي إنسان تختلف طريقتهم في التقدير والحكم والإدراك، وإذا كانت أهمية الشكل تصل إلى القدر الذي يقال عنه أنه توأم الحرية، وإذا كان لابد من وضع جزاء على مخالفة الأشكال والأوضاع التي نص عليها القانون حتى تحتر نواهي القانون وأوامره الأساسية، فمن الواجب مع ذلك أن يحول المشرع دون اتخاذ هذا الإجراء سلاحًا للكيد والمشاكسة والإضرار بالحقوق، فقانون المرافعات وضع ليوجه صاحب الحق إلى السبيل التي تؤدي به إلى حماية حقه والانتفاع به، ومن الواجب أن يكون أداة صالحة ووسيلة بريئة للكشف عن حقيقة الواقع والوصول إليها، ولا يؤدي إلى إهدار الحقوق من أجل الأوضاع وتفضيل الشكل على الموضوع.
فيتعين إذن ألا يحكم بالجزاء إلا إذا استحالت إزالة الضرر الناتج عن المخالفة، ويتعين في كل الأحوال الأخرى التي يمكن فيها إزالة الضرر وتمكين المحكمة من الأمر باتخاذ الإجراءات التي من شأنها استيفاء النقص أو إصلاح الخطأ. ولهذه الفكرة شعاب، منها ما يتصل بالدفع بعدم الاختصاص بأنواعه المختلفة، ومنها ما يتصل بالدفع بالبطلان ومنها ما يتصل بمواعيد التكليف بالحضور.
ولقد اهتدى المشرع إلى هذه الفكرة في القانون رقم 100 لسنة 1962 ولكنه لم يصل بها إلى غاية ما ينبغي أن تصل إليه، واستكمل قانون المرافعات الجديد (رقم 13 لسنة 1968) ما لم يحققه القانون المتقدم.
ومن ناحية أخرى ألغى القانون الجديد بعض الإصلاحات التي وردت في القانون رقم 100 لسنة 1962، وقام بتعديلات أخرى، هي مثار نقد من كل المشتغلين بالقانون في الوقت الحاضر، وذلك وفقًا لما سوف نراه في أبواب هذا الكتاب المختلفة.
