التكييف القانوني أصبح ضرورة حتمية وخصيصة جوهرية لكلا الدعوي والحكم فيها, ولذلك تعين علي القاضي أن يعمل أصول وقواعد التكييف علي النزاع, ولكن ما هو التكييف الذي علي ضوءه يصل القاضي الي حل سليم للنزاع؟ وهذا التساؤل منطقي ومنهجي, فطالما نقرر أن الدعوي لا يمكن الحكم فيها الا بأسلوب أو بمنهج التكييف, فمرفة ماهية التكييف معرفة واجبة ولازمة لكي نعمل لذلك التكييف.
وهذا التساؤل هو جوهر هذا البحث, فبرغم الضرورة القانونية والعنلية لاحتياج التكييف القانوني لحل النزاع علي اسس صحيحة, وبرغم أن ذلك يمثل منهاجاً قضائيا وليس تشريعيا, يسير علية القضاء المصري, منذ ميلاده, الا أنه مع ذلك فالاجابة عن هذا التساؤل ليست سهلة أو هينة, الأمر الذي مهدنا له بكل هذا البحث, وصعوبة الاجابة عن ذلك التساؤل يزكيها ان امشرع المصري لم يتصدي ولوبنص واحد في مجال المنازعات الوطنية لبيان ولو جانب يسير لمضمون الكييف فستطيع أن نسير عليه ونستهدى به ولو كمعيار يضىء لنا ذلك الطريق الوعر في البحث.
ولكي نصل ال منهج سليم في معالجة التكييف القانوني للدعوي في قانون المرافعات, وفي هذا الموضوع الدقيق الشائك فقد اتبعنا قسم أول: وفيه نعالج التكييف القانوني من حيث ماهيته , وتمت المعالجة علي النحو التالي: فصل أول: مدخل ألي التكييف, فصل ثاني: تعريف التكييف فصل ثالث: تمييز التكييف, وقسم ثاني: غطينا فيه التكييف القانوني من حيث مجاله وبالتالي الي الآتي: فصل اول: تحديد الواقع, فصل ثاني: تحديد القانون, فصل ثالث: تكييف التكيف, وقسم ثالث: انتهينا منه الي اجتهاد وقواعد قواعد فنية وأصول عامة هي منهج التكييف القانوني وقسمناه الي بابين: باب اول: مدخل الر تقعيد التكيف, باب ثاني: تقعيد التكييف.
