يتناول القانون الجنائي حماية المصالح الأساسية في المجتمع، وتأتي الجرائم المضرة بأمن الدولة في مقدمة الجرائم التي يتكون منها هذا القانون، ويرجع السبب في ذلك إلى حرص كل دولة على تحقيق حماية فعالة لأمنها الوطني وكيانها السياسي من مخاطر العدوان عليه، وأيًا كانت درجة هذا العدوان، إذ ليس هناك بالنسبة للدولة ما هو أكثر أهمية من حماية ذلك الأمن أو ذلك الكيان.
والقانون الجنائي الذي يعتبر أحد أهم الوسائل التي تلجأ إليها الدولة بهدف تحقيق الحماية الضرورية للقيم والمصالح الحضارية والسياسية والاقتصادية في المجتمع قد عكس منذ القدم مدى الاهتمام والعناية التي كرست لحماية أمن الدولة، وظل ذلك ساندًا حتى الآن، في مختلف العصور وفي مختلف التشريعات. ففي مختلف التشريعات المعاصرة، أخذت الجرائم المخلة بأمن الدولة، مكان الصدارة بين كل الجرائم التي تنص عليها هذه التشريعات، إذ تأتي في مقدمة أبواب التجريم والعقاب التي تتألف منها.
سنتناول في هذا الكتاب، دراسة في هذا الكتاب، دراسة الأحكام الخاصة بجرائم أمن الدولة في التشريعات العربية والقانونين الإيطالي والفرنسي، فندرس كل جريمة على حدة طبقا للنصوص الجنائية، واتجاهات الفقه والقضاء حول الأركان والعناصر والظروف المرتبطة بقواعد التجريم والعقاب، ومدى مطابقة هذه القواعد للأصول الدستورية ومبادئ حقوق الإنسان.
ومن أجل ذلك رأينا تقسيم هذا الكتاب إلى ثلاثة أبواب على النحو التالي: الباب الأول: ويحتوي على الأحكام الخاصة بالجرائم المخلة بأمن الدولة، الباب الثاني: ويضم الجرائم المضرة بأمن الدولة من جهة الخارج، الباب الثالث: ويخصص للجرائم المرتكبة ضد أمن الدولة الداخلي. على أننا رأينا أن نبدأ بفصل تمهيدي يتناول التطور التاريخي لجرائم أمن الدولة.
