والجرائم الماسة بهذه المصالح أشد جسامة من غيرها من الجرائم المضرة بالمصلحة العامة بل حتى تلك الماسة بالأمن الداخلي، لأن ضررها المادي أو خطرها أبلغ أثراً؛ كونه يمس الدولة في وجودها وكيانها.
وإن التطورات السياسية والمعلوماتية وأثرها في مفهوم الأمن ونطاقه يدعو الفقه والتشريع الجزائي إلى مواكبة الأفعال التي تهدد المصالح الخاصة بأمن الدولة الخارجي، فضلاً عن ذلك قد تنوعت صور المساس والإخلال بالأمن الخارجي للدولة لا سيما في الوضع الراهن للعراق؛ وتعرضه للعدوان الخارجي والداخلي المتمثل بالجماعات الإرهابية المدعومة من قبل دول عديدة، كذلك وجود الدعم الداخلي من قبل بعض الأفراد التي تخضع أفعالهم للنموذج القانوني للجرائم الماسة بأمن الدولة.
