أوردت غالبية التشريعات العربية المستمدة من التشريع الفرنسي أحكاماً خاصة بالجرائم الواقعة على أمن الدولة منها ما جاء في القسم العام لقانون العقوبات "كإمتداد سلطان قانون العقوبات"، ومنها ما تضمنته قوانين المحاكم الخاصة أو الإستثنائية كتحديد جهة إختصاص النظر في تلك الجرائم، ومنها ما جاء في باقي نصوص القسم الخاص من قانون العقوبات كتجريم عدم الإبلاغ عن الجرائم الواقعة على أمن الدولة، وخرجت تشريعات عديدة عن أحكامها العامة والواردة في القسم العام من قانون العقوبات وخصت التحريض على إرتكاب الجرائم الواقعة على أمن الدولة بأحكام مغايرة.
وسنضمن هذه الموضوعات للباب الأول من هذا المؤلف، بالإضافة إلى الأحكام العامة الواردة في بعض التشريعات تحت هذا العنوان، التي تصدرت الجرائم الواقعة على أمن الدولة، والتي هي بمثابة احكام خاصة لتلك الجرائم، والأصل أن لا تطبق عليها إلا إذا ورد نص يقضي بسريانها على جرائم أخرى تماثل الجرائم الواقعة على أمن الدولة في الأهمية.
وقد نص المشرع الأردني على تلك الأحكام في المواد 107، 108، 109 من قانون العقوبات، وهي تتعلق بالمؤامرة وأحكامها، والإعتداء والأعذار المحلة والمخففة بمناسبة الإبلاغ عن الجرائم الواقعة على أمن الدولة؛ وسنخصص الباب الثاني للجرائم الواقعة على أمن الدولة الخارجي حسب التقسيم الذي أخذ به المشرع الأردني والتشريعات العربية، وستكون الجرائم الواقعة على أمن الدولة الداخلي وجرائم الإرهاب موضوع الباب الثالث من هذا الكتاب.
