يدور موضوع الكتاب حول تنازع القوانين ذات العنصر الأجنبي وعلاقتها بقانون القاضي في المسائل ذات الطابع الدولي. والتي تسمح بتطبيق القاضي الوطني لقانون غير قانون دولته. يعرف المؤلف قانون القاضي "بأنه القانون الوطني بوصفه قانون المحكمة التي يطلب إليها أمر حسم المنازعة ذي العنصر الأجنبي. أو هو قانون البلد الذي تقام فيه الدعوى...".
تأتي أهمية دراسة وتحديد الحالات التي يختص بها قانون القاضي في حكم المنازعات وذلك في تحديد مركزه في مواجهة القانون الأجنبي الذي ينافس القاضي في حكم تلك المنازعات.
يبحث هذا الكتاب في الوضع الطبيعي للمسألة والمتمثل بمعرفة المساحة أو الحين الذي يتحرك به قانون القاضي أولاً وهو أمر بديهي ناتج من إن القاضي ابتداءً يعنى بتطبيق قانونه ويلتزم بما يرسمه له مشرعه الوطني. إما معرفته بأحكام القوانين الأجنبية أو البحث عن مضامينها فهي مرحلة جاءت بعد تطور العلاقات الدولية وتزايدها بين الدول.
ولما تقدم جاءت الدراسة وفق ثلاثة فصول تناول الفصل الأول، وفي مباحث ثلاثة نظرة عامة في تنازع القوانين ومنهجية قاعدة الإسناد وتعريفاً بقانون القاضي. وفي الفصل الثاني وفي مباحث ثلاثة أيضاً بحث المؤلف في حالات الإختصاص التشريعي الأصلي بقانون القاضي. فيما جاء الفصل الثالث بأربعة مباحث خصصها المؤلف لحالات الاختصاص التشريعي الإحتياطي لقانون القاضي.
