عرفت السمسرة منذ أقدم العصور لدى العديد من الشعوب فكانت أشبه بمؤسسة قائمة بذاتها من خلال شخص يدعى السمسار والذي ينحصر دوره في تقريب وجهات النظر وشروط البيع والتعاقد. وفي هذا الكتاب يقدم المحامي نزيه نعيم شلالا دراسة مقارنة عن دعاوى السمسرة من خلال الفقه والإجتهاد والنصوص القانونية وذلك بشرح معنى السمسرة والسمسار ودور الوسطاء واتعابهم والخلافات التي قد تحصل بينهم وبين أصحاب العلاقة اثناء وبعد اتمام عقود واتفاقية البيع والطرق الجائزة لإثبات السمسرة، ودور الوسطاء في البيع العقاري، وأجر السمسرة والتعهد الشفهي أو الخطي الحاصل بشأنها، والصفة التي أعطاها القانون للسمسار، وكيفية وطرق إثبات عقد السمسرة، والفرق الحاصل بين عمل السمسار ودور الوسيط، ومرور الزمن على الحقوق والمداعاة بها، ودور المحاكم في الوقوف على النية الحقيقية للأدوار والمهام التي يلعبها السمسار أو الوسيط. هذا ويتضمن هذا الكتاب إضافة إلى المواد القانونية التي تحكم عقد السمسرة خمسة ملاحق تضم: -ملحق رقم 1: الوساطة في القانون اللبناني. –ملحق رقم 2: السمسرة في القانون اللبناني. – ملحق رقم 3: نظام الدلالين والسماسرة (1304). –ملحق رقم 4: موجبات الأعضاء والوسطاء المشتركين وحقوقهم في بورصة بيروت. –ملحق رقم 5: نظام العملاء في بورصة بيروت.
