لقد اتجهت الشريعة الاسلامية إلى وضع عقوبات رادعة لكل من ينتهك حقوق الناس وحرياتهم، ولكن هذه العقوبات تقوم على أساس المساواة بين الجريمة المرتكبة والعقوبة المقررة لها، علماً بأن العقوبة تقسم إلى نوعين هما: العقوبة الدنيوية والعقوبة في الآخرة. كما اتجهت إلى الحقيقة المجردة وإلى حماية الفضيلة ومنع الرذيلة وأن الشريعة عامة تنطبق على جميع الناس الحكام والمحكومين، وتتفق أحكامها مع قانون الأخلاق وتتصل بالضمير الانساني الذي يضع رقابة الله على أعماله وأنه يحاسبه على أعماله. ولقد سعت الشريعة إلى تكوين مجتمع فاضل يدعو إلى الخير وينبذ الشر، وتفتح باب التوبة للجاني وتمنع المجرم بالفعل الذي ارتكبه، وتدفعه إلىعمل الخير، وذلك بعد تطبيق العقوبة المقررة بحقه. لقد جاء هذا الكتاب في خمسة فصول قسمت إلى قسمين، تحدث القسم الأول منها عن النظرية العامة للجريمة وأركان الجريمة، وتناول القسم الثاني نظرية العقوبة متحدثاً عن نظرية العقوبة وماهيتها وأقسام العقوبة وأسباب رفع العقوبة بشيء من التفصيل.
