تناول قانون العقوبات المصرى الجنايات والجنح فى كتابين هما الكتاب الثانى وعنوانه الجنايات والجنح المضرة بالمصلحة العمومية. والكتاب الثالث وعنوانه الجنايات والجنح التى تحصل لآحاد الناس. ثم خصص الكتاب الرابع للمخالفات. ذلك لأن الكتاب الأول مخصص للأحكام الابتدائية وقد تناولناه فى النظرية العامة للقانون الجنائى.
فتبويب القسم الخاص مبنى على الموضوع المباشر للجرائم لا على موضوعها غير المباشر. وهذا الموضوع المباشر هو فى جرائم الكتاب الثانى المصلحة العمومية أو بعبارة أصح الأداة الحكومية أو الإدارة العامة. وهو فى جرائم الكتاب الثالث حقوق أساسية جوهرية للفرد تتعلق بشخصه أو بماله.
وسنبدأ فى دراسة القسم الخاص بالجنايات والجنح المنصوص عليها فى الكتابين الثانى والثالث. فنتناول من بين الجنايات والجنح المضرة بالمصلحة العمومية للجرائم المضرة بأمن الحكومة من جهة الخارج والجرائم المضرة بأمن الحكومة من جهة الداخل وجرائم الرشوة واختلاس الأموال الأميرية والاستيلاء والغدر والتزوير، وغير ذلك من الجرائم ثم نعالج الجنايات والجنح المضرة بآحاد الناس ونختم الكتاب بالحديث على المخالفات المخصص لها الكتاب الرابع والأخير من قانون العقوبات.
هذا وسيكون رائدنا فى شرح قواعد التجريم الأسلوب المنطقى لا الأسلوب الحرفى، لأن القانون روح قبل أن يكون حرفاً، كما أننا سنحرص على تحديد طبيعة كل جريمة من حيث وجود الحدث أو عدم وجوده، ومن حيث نوع الحدث، ومن حيث عدد الحدث، ومن حيث الامتداد الزمنى لتنفيذ السلوك، ومن حيث صفة الجانى وعدد الفعلة.
