يقدّم هذا الكتاب قراءة في بحث الإرث وفق رؤية مختلفة عما كانت عليه، بعد تحديد مفهومَي «الكتاب» و«الفريضة»، إضافة إلى تفصيل موضوع الزواج، وإضافة مواضيع كملك اليمين والطلاق والأم العازبة، وإعادة صياغة مفهوم السنّة على نحو أكثر دقة من السابق.
كما يتناول مسائل في «فقه المرأة» كالقوامة والتعدّدية الزوجية وما نتج عنها من إجحاف في حقّ المرأة على امتداد التاريخ الإسلامي. وقد عالج المؤلّف أسباب الجمود في التشريع الإسلامي، والدوافع التاريخية التي كانت وراء تعطيل العقل ووقف الاجتهاد، الأمر الذي أدّى إلى حرمان المرأة الكثير ممّا هو حقٌّ لها. وهذا ما يدفع إلى تناول السنّة النبوية ومناقشة ما سمّي «علم أسباب النزول» وأسباب وضعه قياساً إلى قاعدة أن يكون التنزيل الحكيم صالحاً لكل زمان ومكان.
