"تعود نشأة ظاهرة التدخل الدولي الإنساني إلى أوائل القرن التاسع عشر، عندما قامت بعض الدول الأوروبية بالتدخل في شؤون الدولة العثمانية بحجة حماية حقوق الأقليات، حيث أدعت تلك الدول بأن الدولة العثمانية تعامل الأقليات الدينية والقومية الذين يعيشون في كنفها معاملة لا إنسانية. وجريا مع تلك الحجة طالبت الدول الأوروبية الدولة العثمانية بالكف عن تلك المعاملة، وإعطاء الأقليات الحكم الذاتي في نطاق دولتها أو الاستقلال عنها حماية للقيم الإنسانية. وقد رفضت الدولة العثمانية تلك المطالب، الأمر الذي دفع بالدول الأوروبية بالتدخل العسكري بذريعة حماية حقوق الأقليات، حيث تدخلت روسيا القيصرية في اليونان في عام 1830، وقد أدى هذا التدخل إلى استقلال اليونان، كما تدخلت فرنسا في سوريا في عام 1861، وأسفر عن هذا التدخل احتلال فرنسا لسوريا، وتدخلت روسيا القيصرية في البلقان في عام 1877، وتمخض عن هذا التدخل استقلال بلغاريا والصرب والجبل الأسود والبوسنة والهرسك.والملاحظ على هذه التدخلات إنها تمت في الوقت الذي كانت فيه الدولة العثمانية تعاني من ضعف شديد.
وعلى العموم، أثارت تلك التدخلات جدلا كبيرا بين فقهاء القرن التاسع وأوائل القرن العشرين بين مؤيد ومعارض له، فالمؤيدين له يرون فيه، إن حق الدول الأوروبية التدخل لحماية حقوق الأقليات، وأن هذا النوع من التدخل لا يعد حربا عدوانية، وإنما حرب عادلة؛ لرفع الظلم عن المظلومين؛ فهي حرب موجه ضد كل حاكم يرتكب جرائم إنسانية في حق مواطنيه.أما المعارضون له يرون فيه، محاولة من قبل بعض الدول الأوروبية في استغلال قيم حقوق الإنسان لتحقيق أهداف إنسانية، والمتمثلة في تمزيق وتقسيم الدولة العثمانية التي كانت تسيطر على معظم مداخل ومخارج قارتي أوروبا وأفريقيا.
